Scope of these terms
These terms describe the service currently available.
1Introduction
Welcome to TradingIA ("the Platform," "we" or "our"). By accessing or using the services available at tradingia.ai, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you ("User," "you" or "your") and TradingIA governing your access to and use of our AI-driven automated cryptocurrency trading services.
2Description of the Service
AI Brain analyzes 291 signals every 5 minutes and decides. In SPOT: buys on signals with limit orders and takes profit when in the green. In FUTURES: hedging with a stop-loss always on the exchange. No fixed trading rules: each decision is made with that minute's market. Your money stays on your exchange (Binance, Kraken, OKX). You set the risk.
TradingIA is a technology platform that provides automated trading tools. We do not provide financial advice, investment recommendations or portfolio management services.
3Eligibility
To use TradingIA, you must:
- Be at least 18 years old (or the legal age of majority in your jurisdiction)
- Have the legal capacity to enter into a binding agreement
- Not be a resident of a jurisdiction where cryptocurrency trading or automated trading services are prohibited
- Have a valid account on a supported cryptocurrency exchange (currently Binance and Kraken)
- Comply with all applicable laws and regulations in your jurisdiction regarding cryptocurrency trading
4Account Registration and Security
By creating a TradingIA account, you agree to:
- Provide accurate, current and complete registration information
- Maintain and promptly update your account information
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account You are solely responsible for keeping your account credentials secure. TradingIA will never ask for your password.
5Use of API Keys and Security of Funds
To use our trading services, you must provide API keys from your cryptocurrency exchange. By doing so, you acknowledge and agree that:
- API keys must be created with trade-only permissions. Withdrawal permissions must NOT be enabled.
- Your funds remain on your exchange at all times. TradingIA never has custody of, access to, or the ability to withdraw your funds.
- API keys are encrypted using Fernet encryption (AES-256) and stored securely in our infrastructure.
- All communication between TradingIA and your exchange is encrypted through a private VPN tunnel.
- You are responsible for ensuring your API keys have the correct permissions (trade only).
- TradingIA reserves the right to reject API keys with withdrawal permissions enabled. TradingIA will never request API keys with withdrawal permissions. If anyone claiming to represent TradingIA requests such keys, do not comply and report it to us immediately at tradingia.ai/#contact.
6Fees and Payments
TradingIA charges the following fees for its services:
- Monthly subscription fee: varies by plan level (Starter, Pro, Premium, Elite)
- Performance fee: a percentage of the positive net profits generated by our trading
- Performance fees are calculated only on NET profits — if the platform generates no profit, no performance fee is charged
- Fees are billed in USDT or equivalent cryptocurrency
- Subscription fees are due at the start of each billing cycle
- Performance fees are calculated and billed at the end of each billing period We reserve the right to modify our fee structure with 30 days' prior notice. Continued use of the Platform after fee changes constitutes acceptance of the new structure.
7Acknowledgment of Risks
By using TradingIA, you expressly acknowledge and agree that:
- Cryptocurrency trading involves a substantial risk of loss and is not suitable for all investors
- Past performance is not indicative of future results
- Algorithmic trading systems, including AI-driven ones, can and do suffer losses
- Market conditions can change rapidly and no algorithm can predict every market move
- You may lose part or all of your invested capital
- TradingIA does not guarantee returns, profits or specific performance levels You should only trade with funds you can afford to lose entirely. Please review our Risk Notice for full information on risks.
8Intellectual Property
All content, technology, algorithms, software, trading strategies, signal analysis methods and other intellectual property associated with TradingIA are the property of TradingIA and are protected by applicable intellectual property laws. You may not:
- Copy, modify, distribute or reverse engineer any part of our technology
- Attempt to extract or replicate our trading algorithms or signal-processing methods
- Use our platform to develop competing products or services
- Share, resell or sublicense your access to TradingIA
- Scrape data, mine data or systematically access our APIs beyond normal platform use
9Prohibited Conduct
You agree not to:
- Use TradingIA for any illegal purpose or in violation of any applicable regulation
- Attempt to manipulate markets or engage in wash trading, spoofing or other market manipulation
- Interfere with the operation of the Platform or other users' access
- Provide false or misleading information during registration or at any time
- Use automated tools to access the Platform beyond normal API use
- Share API keys or account access with unauthorized third parties
- Use TradingIA to launder money or finance illegal activities
10Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- TradingIA provides its services "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied
- TradingIA shall not be liable for trading losses, lost profits, lost data or any indirect, incidental, special, consequential or punitive damages
- TradingIA's total aggregate liability shall not exceed the fees paid by you to TradingIA in the 12 months preceding the claim
- TradingIA is not responsible for exchange downtime, API failures, network problems or other factors beyond our control
- TradingIA is not responsible for losses resulting from exchange hacks, insolvency or regulatory actions affecting your exchange Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11Disclaimers
TradingIA is NOT:
- A financial advisor, investment advisor or broker
- A provider of financial advice, investment advice or recommendations
- A custodian of your funds or a money transmitter
- A guarantor of returns, profits or performance All information provided through the Platform, including market signals, scores, AI Brain analysis and trading activity, is for informational and technological purposes only. Nothing on this Platform constitutes financial advice or a recommendation to buy, sell or hold any cryptocurrency. You are solely responsible for your own investment decisions and should consult qualified financial professionals before making investment decisions.
12Service Availability and Changes
TradingIA strives to maintain continuous service availability but does not guarantee uninterrupted access. We reserve the right to:
- Modify, update or discontinue any feature or service at any time
- Perform maintenance that may temporarily affect service availability
- Update our trading algorithms and strategies without prior notice
- Add or remove supported exchanges
- Change system parameters and risk management settings We will make reasonable efforts to notify users of significant changes by email or platform notifications.
13Termination
Either party may terminate this agreement at any time:
- You may close your account and disconnect your API keys at any time through the Platform settings
- TradingIA may suspend or terminate your account if you violate these Terms, engage in prohibited conduct or if required by law
- Upon termination, all trading activity on your behalf will cease immediately
- You remain responsible for any fees incurred before termination
- We will retain your data in accordance with our Privacy Policy Termination does not affect any right or obligation that arose before termination.
14Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the principles of applicable international commercial law. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved by: 1. Good-faith negotiation between the parties for a period of 30 days 2. If negotiation fails, binding arbitration under internationally recognized arbitration rules You agree to waive any right to participate in class actions or class arbitration against TradingIA.
15Changes to the Terms
TradingIA reserves the right to update or modify these Terms at any time. When we make material changes:
- We will update the "Last updated" date at the top of this page
- We will notify users by email or platform notification
- Continued use of the Platform after the changes constitutes acceptance of the modified Terms
- If you disagree with any change, you must stop using the Platform and close your account We recommend reviewing these Terms periodically.
